若手弁護士エスワイ先生のブログを見習って、CA州弁護士登録に関する備忘を残しておく。
今回は、「moral character determination」編である。
特に秩序立った形ではなく、「出た順」で記述していくので通読には適さないかもしれないが悪しからず。
（なお、指紋採取に行ってきたin東小金井でも書いたとおり、まだカリフォルニア州司法試験の結果待ちだが、合格していることを祈りつつ、カリフォルニア州弁護士登録に必要な手続を進めているものである。）
・「Purpose of Applying」は、「Full admission to the State Bar」でよい。
・「Driving Records」は、「運転記録証明書」の過去5年分を取得すればよい。「無事故・無違反証明書」「運転記録証明書」「累積点数等証明書」「運転免許経歴証明書」の4種類があるので間違わないこと。英文で発行してもらえるし、何ならスマホでも発行申請が可能なので便利。取得後PDF化して「File Upload: Driving Records」からアップロードすればよい。原本を郵送する必要は無い。
・「Pre-Legal Education」について、「Foreign Undergraduate School」を選択した。（自由記載ではなく、選択式の記入欄。しかし、選択肢の一覧が見れず、文字を入力してみて該当する選択肢が表示されないと、何を選ぶこともできない。「Foreign」と入力すると、この選択肢が表れるので選択する。）
・「Accounting for Gaps in Activity」（経歴上の空白期間に関する補足説明）について、自分の場合には「04/2013 – 10/2015: Studied for the Japanese bar exam in Tokyo, Japan; 11/2015 – 12/2016: Completed legal training at the Legal Training and Research Institute of the Supreme Court of Japan to qualify as an attorney」と入力した。「04/2013 – 10/2015」部分について、実際には、東京大学教養学部に在籍していた期間なのだが、卒業しておらず、最終的にも中退したため、敢えて言及する必要はないと考えた。「 11/2015 – 12/2016」については、概ね司法修習期間を指している。
・その他の質問事項（軍役、破産、有罪判決、等）については、適宜「No」「N/A」等と記入した。
・「指紋」と「Certificate of Good Standing」については、（Driving Recordsと異なり）提出する前にアップロードする箇所がなく、また原本を郵送する必要があるので、一旦いずれに関しても何もせずに提出してしまう。その後で、提出済みのapplicationを見ると、「Feed」という投稿欄があるので、以下の要領でアップロードして、さらに、原本を郵送した。
後で追記するかもしれないが、一旦、手続き上悩んだりしたことについて自分なりの解決を記しておく。

お世話になります。
ブログ拝見し参考にさせていただいております。外資系企業にて法務担当しております。
先生と同じくこの２月にCA州Bar試験合格し、Moral Character Determinationを先月中旬に申請しました。
Fingerprint cards２通については６月中にEMSで郵送し郵便追跡で”Delivered”を確認しているにも関わらず、昨日、Imcomplete Applicationとして”Please provide two fingerprint cards in form FD-258″とOffice of Admissionsからメールがきました。
川上先生はこういうことはなかったと思いますが、EMSで発送されましたでしょうか。それともDHLを利用されましたでしょうか。
一応Applicant PortalにTracking recordをPostし対応したのですが、いろいろと不安となっておりまして川上先生は何で郵送されたかをお伺いしたくご連絡しました。

（お互いに）合格おめでとうございます！同じ試験を受験&合格されたとは大変親近感がわきます！
実は、私も全く同じ状況に陥りました！
私の場合にはDHLを利用したのですが、受領確認済みにもかかわらず、全く同じ内容のメールが届きました（お持ちかと思いますが、下のメール1に添付します（笑））。
これに対して、私はまさに全く同じように「Applicant PortalにTracking recordをPost」するという対応をとったところ（その際、結構、イライラした文章を付けたと思います（笑））、音沙汰がなく、ちょうど1週間ほど後、下のメール2が届きました。
ですので、先生も大丈夫かと…。
本当に、ずぼらでいい加減な連中で、怒りしかわきませんよね…。

Your moral character application has been received; however, it is incomplete and therefore not considered filed. Please correct the deficiencies indicated below and submit any required information or documentation within 60 days of the date of this message. Your application will be considered filed on the date the deficiencies have been resolved.

Missing Item Details:
1. Fingerprint Cards: Our records indicate that you provided tracking information on April 22, 2025 for your submitted Fingerprint cards. There is no further action needed from you at this time. We will notify you once the cards are received.
Follow the steps indicated below to upload documents and post a response to this notice:
Log in to your Applicant Portal.
Scroll down to “My Applications.”
Click on the case number associated with your most recent Moral Character Application.
Click on the text box labeled “Post” to add any relevant comments, then click on the paper clip icon below the text box to attach any documents.
Applicants registered as out-of-state or foreign attorneys are required to provide an original Certificate of Good Standing to receive a moral character determination. In addition, out-of-state applicants must submit two fingerprint cards on form FD-258. Original Certificates of Good Standing and fingerprint cards must be delivered via certified mail to and received by the Los Angeles Office of Admissions (845 S. Figueroa St., Los Angeles, CA 90017). All other documents submitted by general and attorney applicants must be uploaded or posted to the moral character application via the Applicant Portal (please see the instructions above). If hard copies are provided for any documents other than a Certificate of Good Standing or fingerprint cards, they will be destroyed and will not be returned to you.
Should deficiencies not be resolved, or your application not brought to a complete and filed status within 60 days of the date of this letter, your application will be abandoned. Any previously submitted fees will not be refunded in the event the application is considered abandoned. Subsequently, if you wish to proceed with the moral character determination process, you must file a new Application for Determination of Moral Character, pay the filing fee associated with that application, and submit new fingerprints pursuant to Rule 4.43(B) of the Admissions Rules.
If you have any questions, please contact the Moral Character Pre-Processing unit by posting a question to your moral character case in the Applicant Portal by following the steps above or calling the State Bar at (800) 843-9053. Please do not reply directly to this email, as this inbox is not monitored.
